We are committed to protecting your personal data and handling it responsibly in accordance with Singapore’s Personal Data Protection Act 2012 (the “PDPA”) and other applicable data protection laws.

This Privacy Policy explains how we collect, use, disclose and protect your personal data when you visit our website or engage our services.

2. Personal data we collect

When you contact us or work with us, we collect only the personal data we need. This may include:

• Your name and the name of your business or organisation
• Contact details, such as your email address and phone number
• Project information and any materials you share with us
• Records of our correspondence, quotations and invoices
• Payment records, such as the amount, date and payment reference

Card payments are processed by our payment provider, such as Stripe. We do not see or store your full card details. The payment provider handles them under its own privacy policy.

When you visit our website, our hosting provider automatically records basic technical information, such as your IP address, browser type and the pages you visit. This is used to keep the website secure and working properly.

3. How we use your data

We use personal data to:

• Respond to your enquiries and communicate with you
• Prepare quotations and deliver, manage and support your project
• Process payments and keep business records
• Meet our legal, regulatory and record-keeping obligations

We will not use your personal data to send you marketing without your consent.

4. Data in projects we build or run for you

Some of our work involves personal data belonging to other people, such as attendee details for event lanyards, customer bookings, quiz results or the details shown on a digital profile.

For these projects, you, as our client, are the organisation responsible for that data under the PDPA. We handle it only on your instructions and only to build, deliver or run the service you have asked for. We do not use it for any other purpose.

You are responsible for obtaining any consent needed to collect that data and share it with us.

5. Sharing your data

We do not sell, rent or trade personal data, and we do not share it with third parties for their own marketing.

We share personal data only where it is needed to deliver our services, with:

• Service providers we use to run our business, such as website hosting, email, cloud storage and our card payment provider
• Suppliers we work with to produce your project, such as printers
• Authorities, where we are required to by law, a court order or a competent authority

Our service providers and suppliers may only use the data to provide their service to us.

6. Storage outside Singapore

When we host websites or systems for your project, we use servers located in Singapore or South East Asia where available.

Some of the other services we use, such as email and card payments, may store data outside Singapore. Where this happens, we take reasonable steps to make sure your data receives a standard of protection comparable to that under the PDPA.

7. How long we keep your data

• For websites and systems we host during your project, data is kept while the project is active. When the project closes, the system is either handed over to you, or shut down and its data deleted.
• Quotations, invoices and payment records are kept for as long as Singapore law requires.

When data is deleted, it is removed from our active systems in a secure way so that it can no longer be read or reconstructed.

8. Protecting your data

We make reasonable security arrangements to protect personal data against unauthorised access, collection, use, disclosure, copying, modification or disposal. These include limiting access to those who need it and using secure tools for storage and communication.

9. Your rights under the PDPA

Subject to the PDPA, you have the right to:

• Request access to the personal data we hold about you, and information about how it has been used or disclosed in the past year
• Request correction of any inaccurate or incomplete data
• Withdraw your consent to our collection, use or disclosure of your data

If you withdraw consent, we may be unable to continue providing some services to you. If your data is held as part of a project we run for one of our clients, we may refer your request to that client.

10. Cookies

Our website does not use cookies. It loads fonts from Google Fonts, which means your browser connects to Google’s servers and shares your IP address with Google. If we start using cookies, we will update this section.

11. Changes to this policy

We may update this Privacy Policy from time to time. Any changes will be posted on this page with a revised “Last updated” date.

1. Agreement to these terms

These Terms of Service (“Terms”) govern your use of the websites, digital tools, creative products and services provided by Creations & Co. (“we”, “us” or “our”). Creations & Co. is an independent creative studio based in Singapore. By confirming a quotation or engaging our services, you agree to be bound by these Terms.

2. Our services

Creations & Co. designs and builds websites, digital tools and creative products. The scope, deliverables, timeline, any revision rounds and price of each project are set out in your quotation.

NFC and QR features depend on the device and settings of the person using them. Most modern smartphones support them, but we cannot guarantee that they will work on every device.

3. Quotations and confirmation

Before we start, we will send you a quotation setting out the scope of work, deliverables, timeline and fees. Your project is confirmed when you accept the quotation in writing or pay the deposit. We set aside time for your project from that point, so please check the quotation carefully before confirming.

If you would like to change the scope after confirming, let us know. We will tell you whether the change affects the timeline or fees before we go ahead.

4. Cancellations and refunds

Our work is a service, and we reserve time and begin work for your project once it is confirmed. For that reason:

• If you cancel before work starts, we will refund your deposit in full. Once work has started, the deposit is non-refundable.
• If you cancel after work has started, fees are payable for the work completed up to the date of cancellation.
• Fees for work that has been delivered and approved are non-refundable.
• Custom physical products, such as printed or NFC cards, are made to your specifications and cannot be returned or exchanged once production has started.

If anything we deliver does not match what was agreed in your quotation, please tell us and we will correct it at no extra cost. This does not affect any rights you have under Singapore law.

5. Payment

Payment terms, including any deposit, are set out in your quotation or invoice. Payment is made by card through our payment provider, such as Stripe, in the agreed currency and by the agreed due date.

Final files are released, and websites or services are launched, once payment is complete, unless we agree otherwise. If a payment is overdue, we may pause work until it is settled.

6. Your responsibilities

You agree to:

• Provide accurate information and the materials we need to complete your project
• Check details such as names, spelling and contact information before approving work or production
• Make sure any content you supply does not infringe the rights of others
• Where you share personal data belonging to other people, such as attendee lists or customer details, make sure you have the consent needed under the PDPA

7. Hosting and handover

While your project is active, we host your website or system for you. Any hosting or domain costs are set out in your quotation.

When the project closes, you can choose to take it over and manage it yourself. We will hand over the files and access you need. If you do not take it over, we will shut it down after the project closes and delete its data. We will let you know before we do this.

We take reasonable care to keep hosted websites and systems available and secure. Because they rely on third-party hosting and network providers, we cannot guarantee uninterrupted access.

8. Intellectual property

Once full payment has been received, you own the final deliverables created specifically for you, such as your designs, content and branded materials, unless we agree otherwise in writing.

We keep ownership of our own tools, code, templates and methods that we created before your project or use across projects. We grant you a licence to use them as part of your deliverables.

We may show non-confidential work in our portfolio and marketing materials unless you ask us in writing not to. We will not show personal data from your project without your permission.

9. Limitation of liability

We provide our services with reasonable care and skill. To the fullest extent permitted by law, our total liability for any project is limited to the amount you paid for that project, and we are not liable for indirect or consequential losses. Nothing in these Terms limits any liability that cannot be limited under Singapore law.

10. Changes to these terms

We may update these Terms from time to time. Any changes will be posted on this page with a revised “Last updated” date. Changes do not affect projects that have already been confirmed.

11. Governing law

These Terms are governed by and construed in accordance with the laws of Singapore.
